1. Acceptance of these Terms
These Terms of Use (the "Terms") form a legal agreement between you and Bencaodian Editorial ("we", "us") governing your access to and use of bencaodian.org and all of its subpages, tools, and data (the "Platform"). By accessing or using the Platform in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Intended audience
The Platform is a scholarly and educational reference aimed at students, researchers, and trained practitioners of Chinese medicine. Its content presents the core knowledge of college-level TCM textbooks and classical sources. It is not directed to patients, consumers, or lay readers seeking to self-diagnose or self-prescribe.
If you are not a trained reader in this sense, please do not rely on any content from this Platform as a basis for clinical decisions or self-medication. Consult a qualified TCM practitioner, your treating physician, or the appropriate specialist.
3. Not medical advice
All content on this Platform — including herb entries, formula compositions, pattern descriptions, dosage ranges, contraindications, drug-interaction notes, case records, classical translations, and all tools (differentiation wizard, formula builder, interactions checker, etc.) — is provided for scholarly reference only and does not constitute medical advice, diagnosis, prescription, or a treatment plan.
Chinese herbs are not safe simply because they are "natural." Many have powerful pharmacological effects, and some are frankly toxic. An incorrect diagnosis, an incorrect prescription, incorrectly processed material, or an incorrect dose can all cause serious harm. Clinical decisions must be made by a qualified licensed practitioner based on the individual patient, in coordination with the patient's treating physician.
Dose ranges shown on this Platform are traditional reference ranges, not personalized prescriptions. Classical acute-rescue doses are preserved as historical reference only; you must not rely on this Platform for the management of acute or emergency conditions.
4. Vulnerable populations
Dose ranges on this Platform are stated for non-pregnant adults. Pregnancy, lactation, and pediatric use are outside the scope of this Platform — any use in these populations must be managed by a qualified TCM practitioner or the appropriate specialist on an individual basis. We deliberately do not provide pregnancy, lactation, or pediatric dosing. Where the Platform marks "Pregnancy / Lactation / Pediatric" categories, those marks are protective information only (when to avoid or use with caution); they do not contain dosing guidance.
5. Nature of the tools
All tools on this Platform — including without limitation the differentiation wizard, the formula builder (including Eighteen Antagonisms / Nineteen Fears checking and drug-interaction flagging), the decoction converter, the interactions checker, the quiz modules, and the learn-path checkpoints — are educational reference tools. Any warnings, combination flags, or interaction entries they display are educational data, not a clinical decision-support system, and are not exhaustive. "Not listed" does not mean "safe"; an absence of warnings does not mean an absence of risk. You must not rely on the output of these tools for clinical decisions; independent clinical judgment and authoritative clinical references must be used instead.
6. No warranty
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, or error-free operation. Although the editorial team reviews entries with scholarly rigor, we do not warrant that the content is accurate, complete, or suitable for any particular clinical purpose at any given time. The Platform may contain typographical, factual, or translation errors; if you find one, we will review and correct it within a reasonable period.
7. Limitation of liability
To the maximum extent permitted by applicable law, Bencaodian Editorial, its members, contributors, and affiliates shall not be liable to you or any third party for any damages — including without limitation personal injury, medical loss, economic loss, loss of data, loss of profits, loss of goodwill, punitive damages, or any other damages, whether direct or indirect, arising out of or related to your use of or inability to use the Platform, or any action taken in reliance on any content from the Platform — whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Because the Platform is provided free of charge, our aggregate liability (if any, to the extent applicable law requires that liability exist) shall not exceed the greater of (a) zero US dollars (US$0) and (b) the amount you have actually paid to use the Platform, if any.
8. Your obligations
You agree that you will:
- not use any content from the Platform as the sole basis for clinical decisions or self-medication;
- not scrape the Platform abusively or otherwise interfere with its normal operation;
- respect the applicable licenses when you reuse content or data (source code under MIT; content and data under CC BY-SA 4.0);
- not use the Platform in a manner that violates applicable law.
8A. Community Errata and User Submissions
We accept errata, corrections, and content suggestions through the public GitHub repository at https://github.com/(owner)/bencao-dian/issues — use the "errata" issue templates and include a verifiable source citation for any factual claim.
By submitting any content (issue, comment, pull request, or other contribution) to the Platform or its repository, you grant the editorial team a perpetual, worldwide, royalty-free, sublicensable license to use, modify, and distribute that content under the Platform's published licenses (source code: MIT; content and data: CC BY-SA 4.0).
You represent that any content you submit is your original work or is properly licensed for redistribution under those terms, and that submitting it does not infringe any third party's rights.
Accepted errata are recorded in each entry's revision log; once an entry receives accepted errata, its badge transitions to "Community-corrected".
9. Indemnity
You agree to indemnify, defend, and hold harmless Bencaodian Editorial, its members, contributors, and affiliates from any claim, action, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your breach of these Terms, or your violation of any law or third-party right.
10. Third-party content and links
The Platform references third-party factual data (such as Wikidata cross-reference IDs), fonts, and tools, each governed by its own license. The Platform may also link to third-party sites (e.g. PubMed, Wikidata, font distributors); we are not responsible for the content, accuracy, or availability of any such external site. If you believe any content on the Platform infringes your copyright, please see the Notice and Takedown procedure on the Sources and Copyright page.
10A. DMCA Designated Agent (Notice and Takedown)
The Platform complies with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Copyright holders or their authorized agents who believe content on the Platform infringes their copyright may submit a takedown notice meeting the requirements of 17 U.S.C. § 512(c)(3) to our Designated Agent.

11. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the State of Oregon, United States of America, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Platform or these Terms shall first be addressed by good-faith negotiation between the parties. If negotiation fails, either party may bring the dispute before a court of competent jurisdiction in the State of Oregon, United States of America, which shall have exclusive jurisdiction. To the maximum extent permitted by applicable law, you waive any right to participate in class-action proceedings.
12. Changes to these Terms
We may revise these Terms from time to time. Any material change will be reflected in the effective date at the top of this page. Your continued use of the Platform after the revised Terms take effect constitutes acceptance of the revision. If you do not agree, please discontinue use.
13. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
